By accessing or using Apex CRE AI, you agree to these Terms and all applicable laws and regulations. If you do not agree, you may not access or use our Services.
We may update these Terms periodically. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

2. Use of Services
Apex CRE AI provides tools for commercial real estate data analysis, portfolio management, and AI-driven insights. You agree to use the Services only for lawful business purposes and in accordance with these Terms.
You agree not to:
•    Copy, modify, or reverse-engineer any part of the platform.
•    Use the Services to upload unlawful or infringing content.
•    Interfere with or disrupt the operation or security of the Services.
•    Share your account credentials or allow unauthorized access.

3. Account Registration and Access
To use certain features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property
All content, software, design, data models, and materials within Apex CRE AI are owned or licensed by Newton Method, LLC and are protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the platform for your organization’s internal business purposes only.

5. Data and Privacy
By using Apex CRE AI, you agree to our Privacy Policy and consent to the collection and use of your data as described therein.
You retain ownership of your input data. However, by submitting it to our platform, you grant us a limited license to process, analyze, and display that data for the purpose of providing Services.
We will not sell, share, or disclose your data to third parties except as required by law or outlined in our Privacy Policy.

6. AI and Data Disclaimer
Apex CRE AI uses advanced AI algorithms, data analytics, and predictive modeling to generate insights and recommendations.
While we strive for accuracy and reliability, all outputs are advisory in nature and provided for informational purposes only. They do not constitute financial, investment, or legal advice.
You are solely responsible for evaluating all outputs and making final business or investment decisions.

7. Service Availability
We aim to maintain continuous access to the platform but do not guarantee uninterrupted operation. We may suspend or modify the Services temporarily for maintenance, updates, or improvements.

8. Fees and Payments
Certain features or plans may require payment. All fees are listed in U.S. dollars and are non-refundable except as required by law.
Failure to pay fees may result in suspension or termination of your account.

9. Limitation of Liability
To the fullest extent permitted by law, Newton Method, LLC and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of Apex CRE AI.
Our total liability shall not exceed the amount paid by you (if any) in the twelve months preceding the claim.

10. Indemnification
You agree to indemnify and hold harmless Newton Method, LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.

11. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or if your use poses a security, legal, or reputational risk to the platform or other users.

12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles.
Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
